The CAA “Myrtle Beach Loves Canada” (“Contest”) is sponsored by CAA Magazine, a property of the Canadian Automobile Association, a not-for-profit Automotive Club operating in various territories of Canada (collectively referred to as, the “CAA”) in collaboration with 1772887 Ontario Limited o/a St. Joseph Media (“Strategic Content Labs” and, together with CAA, collectively hereinafter, the “Sponsors”).
By submitting an entry, each entrant agrees to these official rules and regulations (“Rules”) and warrants that his/her entry complies with all requirements set out in the Rules.
The contest starts on Thursday, November 14, 2019, at 12:00 PM (EST) and ends on Thursday, February 6, 2020, at 5:00 PM (EST), subject to change upon notice from the Sponsors.
NO PURCHASE NECESSARY. To enter the contest, visit the website located at https://www.caasco.com/CAA-Magazine/Destinations/2019/myrtle-beach-contest-entry-form and submit your entry form by following the instructions provided.
To be eligible to enter the contest you must:
(a) be a legal permanent resident of Canada (excluding the Province of Quebec);
(b) be of the age of majority or older in your province or territory of residence at the time of entry;
Entries will be declared invalid if (i) they are late, illegible, incomplete, damaged, irregular, mutilated, forged, garbled; (ii) mechanically or electronically reproduced.
Limit of one entry per person during the Entry Period. All entries must be received no later than the end of the Entry Period. All entries become the property of the Sponsors. Entries not complying with these Rules will be disqualified.
Employees, representatives or agents of the Sponsors, their respective affiliates, subsidiaries, partners, affiliated companies, distributors, advertising and promotional agencies, any person or entity involved in the production, implementation, administration or fulfillment of the program, a member of the immediate family of any of the above and any person with whom they are domiciled, are not eligible to participate. For the purposes of these Rules, “immediate family” refers to the father, mother, brothers, sisters, children, husband, wife or partner of such an employee, agent and/or representative.
The Sponsors shall have the right at any time to require proof of identity and/or eligibility to participate. Failure to provide such proof may result in disqualification. All personal and other information requested by and supplied to the Sponsors for the purpose of the program must be truthful, complete, accurate and in no way misleading. The Sponsors reserve the right, in their sole discretion, to disqualify any entrant should such an entrant at any stage supply untruthful, incomplete, inaccurate or misleading personal details and/or information.
The contest prize is a 5-day 4-night trip for two to Myrtle Beach, South Carolina (not including airfare), with attractions tickets to a choice of two attractions and a live music theater show with dining certificates up to $100. Valued at approximately $950.
The winner and their guest must be available to travel from March 1, 2020, through December 30, 2020, subject to availability. Other restrictions, including certain blackout dates, may apply.
The prize (or portions thereof) is non-exchangeable, non-transferable, non-refundable, has no cash surrender value and must be accepted as awarded with no substitutions. Should a winner be unable to claim the prize (or a portion thereof) as awarded, such winner’s right to the prize (or portion thereof) will be forfeited and another winner will be selected.
In the event where it would be impossible, difficult and/or more costly for the Sponsors to award the prize (or a portion thereof), the Sponsors reserve the right to substitute and/or modify the prize (or a portion thereof) with a prize (or portion thereof) of equivalent or greater value.
The winner of the prize acknowledges that upon awarding of the prize, the obligations related to it become the responsibility of the providers of services and goods related to such prize.
The winner will be selected by random draw from all eligible entries on Wednesday, February 12, 2020, by a representative of CAA Magazine at 111 Queen Street East, Suite 320, Toronto, Ontario, M5C 1S2.
The winner will be contacted by telephone and/or e-mail.
In the event the selected entrant cannot be contacted within three (3) days of the selection date, he/she will be disqualified and another entrant will be selected in accordance with these Rules. The Sponsors are not responsible for the failure for any reason whatsoever of selected entrant to receive notification.
By entering the contest, entrants agree to be bound by these Rules.
Before being declared a “winner”, the selected entrant will be required to execute and deliver the Sponsors’ form of agreement and release: (i) confirming compliance with the Rules and acceptance of the prize as offered; (ii) releasing the Sponsors and their respective parent companies, subsidiaries, affiliates, employees, directors, officers, suppliers and agents from any and all liability for any loss, harm, damages, cost or expense arising out of participation in this or participating in any prize-related activity or the acceptance, use or misuse of the prize, including without limitation costs injuries, losses and damages related to personal injuries, death, damage to, loss or destruction of property, rights of publicity or privacy, defamation, or portrayal in a false light, or from any and all claims of third parties arising therefrom; and (iii) granting the Sponsors the unrestricted right, in their sole discretion, to publish, without any further compensation, the name, picture, portrait, likeness, voice and ideas of the selected entrant for advertising and promotional purposes.
Any attempt to deliberately undermine the legitimate operation of this is a violation of criminal laws, and should such an attempt be made, the Sponsors reserve the right to seek remedies and damages to the fullest extent permitted by law, including criminal prosecution.
Any entry form and any attempt at entering using electronic, computer or other means which are contrary to the spirit of the contest or to these Rules (e.g., computer pirating, mass e-mailing, etc.) will be automatically rejected and may be referred to the appropriate judicial authorities. Any automated entries will be noticed and rejected.
In the event of a dispute regarding who submitted an entry form, the entry form will be deemed to have been submitted by the authorized account holder of the e-mail address submitted at the time of entry. “Authorized account holder” is defined as the person who is assigned an e-mail address by an internet provider, online service provider, or other organization (e.g., business, educational institute, etc.) that is responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address.
A selected entrant may be required to provide proof that he/she is the authorized account holder of the e-mail address associated with the selected entry. The sole determinant of the time for the purposes of a valid entry in this will be the server machine(s).
In consideration for the prize, the winner authorizes the Sponsors, if required, to use his/her name, photograph, place of residence, voice, image and/or declaration regarding the prize for advertising purposes without any form of compensation. Moreover, the winner agrees to permit his/her name and town of residence to be broadcasted on the website and published in CAA Magazine without any form of compensation.
The information on the entry forms will be used to administer this only. If an entrant has consented by way of the opt-in on the entry form, the Sponsors may, from time to time, use the personal information provided in connection with the “Contest” (name, postal code and e-mail address) to: (i) contact the winning entrant for the purpose of delivering the prize; (ii) contact entrants directly regarding products, promotions and services provided by the Sponsors and their affiliates; and (iii) research the effectiveness of their websites and the marketing, advertising and sales efforts of the Sponsors and their affiliates. The Sponsors will treat all personal information in accordance with applicable privacy laws. It is the intention of the Sponsors that all personal information provided in connection with the “Contest” will be kept confidential and used only for the purposes outlined herein. By entering the contest, entrants consent to the use of their personal information for the purposes described herein.
Without limiting the generality of the foregoing, the Sponsors assume no responsibility or liability for lost, late, misdirected or incomplete entries, notifications, responses, replies, or any agreement and release documents or for any computer, online, telephone, hardware, software or technical malfunctions that may occur (including but not limited to malfunctions that may affect the transmission or non-transmission of an entry). The Sponsors are not responsible for any incorrect or inaccurate information, whether caused by website users or by any of the equipment or programming associated with or utilized in the “Contest” or by any technical or human error which may occur in the processing of entries. The Sponsors assume no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or alteration of, entries. The Sponsors are not responsible for any problems, failures or technical malfunction of any telephone network or lines, computer online systems, servers, providers, computer equipment, software, e-mail, browsers, on account of technical problems or traffic congestion on the Internet, at any website, or on account of any combination of the foregoing. The Sponsors are not responsible for any injury or damage to entrants or to any computer related to or resulting from participating or downloading materials in this program. The Sponsors reserve the right, at their sole discretion, to cancel, terminate, modify or suspend the contest in whole or in part, should human intervention or an event take place that could alter or affect the administration, security, impartiality or conduct of the contest as provided in these Rules.
This contest is void in the Province of Quebec and where prohibited. Entrants agree that participation thereto is subject to and governed by the laws of the Province of Ontario and the forum for any dispute shall be in the District of Toronto, Ontario. These Rules are subject to change without notice in order to comply with any applicable federal, provincial and municipal laws or the policy of any other entity having jurisdiction over the Sponsors.
