CAA “WIN A COPY OF Ingenious: How Canadian Innovators Made the World Smarter, Smaller, Kinder, Safer, Healthier, Wealthier and Happier” RULES AND REGULATIONS

The CAA “Win a Copy of Ingenious: How Canadian Innovators Made the World Smarter, Smaller, Kinder, Safer, Healthier, Wealthier and Happier” (“Contest”) is sponsored by CAA Magazine, a property of the Canadian Automobile Association, a not-for-profit Automotive Club operating in various territories of Canada (collectively referred to as, the “CAA”) in collaboration with 9778748 Canada Inc. (“Totem” and, together with CAA, collectively hereinafter, the “Sponsors”).

By submitting an entry, each entrant agrees to these official rules and regulations (“Rules”) and warrants that his/her entry complies with all requirements set out in the Rules.

CONTEST PERIOD

The contest starts on Wednesday, November 15, 2017, at 8:00 PM (EST) and ends on Wednesday, December 13, 2017 at 5:00 PM (EST), subject to change upon notice from the Sponsors.

HOW TO ENTER

NO PURCHASE NECESSARY. To enter the contest, visit the website located at www.caasco.com/CAA-Magazine/People/ingenious-contest and submit your entry form by following the instructions provided. 

To be eligible to enter the contest you must:

(a) be a legal resident of Canada (excluding the Province of Quebec);

(b) be of the age of majority or older in your province or territory of residence at the time of entry;

Entries will be declared invalid if (i) they are late, illegible, incomplete, damaged, irregular, mutilated, forged, garbled; (ii) mechanically or electronically reproduced.

Limit of one entry per person during the Entry Period. All entries must be received no later than the end of the Entry Period. All entries become the property of the Sponsors. Entries not complying with these Rules will be disqualified.

Employees, representatives or agents of the Sponsors, their respective affiliates, subsidiaries, partners, affiliated companies, distributors, advertising and promotional agencies, any person or entity involved in the production, implementation, administration or fulfillment of the program, a member of the immediate family of any of the above and any person with whom they are domiciled, are not eligible to participate. For the purposes of these Rules, “immediate family” refers to the father, mother, brothers, sisters, children, husband, wife or partner of such an employee, agent and/or representative.

The Sponsors shall have the right at any time to require proof of identity and/or eligibility to participate. Failure to provide such proof may result in disqualification. All personal and other information requested by and supplied to the Sponsors for the purpose of the program must be truthful, complete, accurate and in no way misleading. The Sponsors reserve the right, in their sole discretion, to disqualify any entrant should such an entrant at any stage supply untruthful, incomplete, inaccurate or misleading personal details and/or information.

PRIZES

The contest prize is a copy of Ingenious: How Canadian Innovators Made the World Smarter, Smaller, Kinder, Safer, Healthier, Wealthier and Happier valued at $40.00.

The prize (or portions thereof) is non-exchangeable, non-transferable, non-refundable, have no cash surrender value and must be accepted as awarded with no substitutions. Should a winner be unable to claim the prize (or a portion thereof) as awarded, such winner’s right to the prize (or portion thereof) will be forfeited and another winner will be selected.

In the event where it would be impossible, difficult and/or more costly for the Sponsors to award the prize (or a portion thereof), the Sponsors reserve the right to substitute and/or modify the prize (or a portion thereof) with a prize (or portion thereof) of equivalent or greater value.

The winner of the prize acknowledges that upon awarding of the prize, the obligations related to it become the responsibility of the providers of services and goods related to such prize.

WINNER SELECTION

The winner will be selected by random draw from all eligible entries on Thursday, December 14, by a representative of CAA Magazine at 461 King Street West, 2nd Floor, Toronto, Ontario, M5V 1K4.

The winner will be contacted by telephone and/or e-mail.

In the event the selected entrant cannot be contacted within three (3) days of the selection date, he/she will be disqualified and another entrant will be selected in accordance with these Rules. The Sponsors are not responsible for the failure for any reason whatsoever of selected entrant to receive notification.

GENERAL CONDITIONS

By entering the contest, entrants agree to be bound by these Rules.

Before being declared a “winner”, the selected entrant will be required to execute and deliver the Sponsors’ form of agreement and release: (i) confirming compliance with the Rules and acceptance of the prize as offered; (ii) releasing the Sponsors and their respective parent companies, subsidiaries, affiliates, employees, directors, officers, suppliers and agents from any and all liability for any loss, harm, damages, cost or expense arising out of participation in this or participating in any prize-related activity or the acceptance, use or misuse of the prize, including without limitation costs injuries, losses and damages related to personal injuries, death, damage to, loss or destruction of property, rights of publicity or privacy, defamation, or portrayal in a false light, or from any and all claims of third parties arising therefrom; and (iii) granting the Sponsors the unrestricted right, in their sole discretion, to publish, without any further compensation, the name, picture, portrait, likeness, voice and ideas of the selected entrant for advertising and promotional purposes.

Any attempt to deliberately undermine the legitimate operation of this is a violation of criminal laws, and should such an attempt be made, the Sponsors reserve the right to seek remedies and damages to the fullest extent permitted by law, including criminal prosecution.

Any entry form and any attempt at entering using electronic, computer or other means which are contrary to the spirit of the contest or to these Rules (e.g., computer pirating, mass e-mailing, etc.) will be automatically rejected and may be referred to the appropriate judicial authorities. Any automated entries will be noticed and rejected.

In the event of a dispute regarding who submitted an entry form, the entry form will be deemed to have been submitted by the authorized account holder of the e-mail address submitted at the time of entry. “Authorized account holder” is defined as the person who is assigned an e-mail address by an internet provider, online service provider, or other organization (e.g., business, educational institute, etc.) that is responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address.

A selected entrant may be required to provide proof that he/she is the authorized account holder of the e-mail address associated with the selected entry. The sole determinant of the time for the purposes of a valid entry in this will be the server machine(s).

In consideration for the prize, the winner authorizes the Sponsors, if required, to use his/her name, photograph, place of residence, voice, image and/or declaration regarding the prize for advertising purposes without any form of compensation. Moreover, the winner agrees to permit his/her name and town of residence to be broadcasted on the website and published in CAA Magazine without any form of compensation.

The information on the entry forms will be used to administer this only. If an entrant has consented by way of the opt-in on the entry form, the Sponsors may, from time to time, use the personal information provided in connection with the “Contest” (name, postal code and e-mail address) to: (i) contact the winning entrant for the purpose of delivering the prize; (ii) contact entrants directly regarding products, promotions and services provided by the Sponsors and their affiliates; and (iii) research the effectiveness of their websites and the marketing, advertising and sales efforts of the Sponsors and their affiliates. The Sponsors will treat all personal information in accordance with applicable privacy laws. It is the intention of the Sponsors that all personal information provided in connection with the “Contest” will be kept confidential and used only for the purposes outlined herein. By entering the contest, entrants consent to the use of their personal information for the purposes described herein.

Without limiting the generality of the foregoing, the Sponsors assume no responsibility or liability for lost, late, misdirected or incomplete entries, notifications, responses, replies, or any agreement and release documents or for any computer, online, telephone, hardware, software or technical malfunctions that may occur (including but not limited to malfunctions that may affect the transmission or non-transmission of an entry). The Sponsors are not responsible for any incorrect or inaccurate information, whether caused by website users or by any of the equipment or programming associated with or utilized in the “Contest” or by any technical or human error which may occur in the processing of entries. The Sponsors assume no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or alteration of, entries. The Sponsors are not responsible for any problems, failures or technical malfunction of any telephone network or lines, computer online systems, servers, providers, computer equipment, software, e-mail, browsers, on account of technical problems or traffic congestion on the Internet, at any website, or on account of any combination of the foregoing. The Sponsors are not responsible for any injury or damage to entrants or to any computer related to or resulting from participating or downloading materials in this program. The Sponsors reserve the right, at their sole discretion, to cancel, terminate, modify or suspend the contest in whole or in part, should human intervention or an event take place that could alter or affect the administration, security, impartiality or conduct of the contest as provided in these Rules.

This contest is void in the Province of Quebec and where prohibited. Entrants agree that participation thereto is subject to and governed by the laws of the Province of Ontario and the forum for any dispute shall be in the District of Toronto, Ontario. These Rules are subject to change without notice in order to comply with any applicable federal, provincial and municipal laws or the policy of any other entity having jurisdiction over the Sponsors.

CAA “SUBMIT YOUR PHOTO” RULES AND REGULATIONS

The CAA “Submit Your Photo” is sponsored by CAA Magazine, a property of the Canadian Automobile Association, a not-for-profit Automotive Club operating in various territories of Canada (collectively referred to as, the "CAA") in collaboration with 9778748 Canada Inc. (“Totem” and, together with CAA, collectively hereinafter, the “Sponsors”).

By submitting a photo (the “Photo”), each entrant agrees to these official rules and regulations (“Rules”) and warrants that his/her submission complies with all requirements set out in the Rules.

CONTEST PERIOD

The contest starts on March 1, 2017, at 12:00 am (EST) and ends on May 15, 2017 (EST), subject to change upon notice from the Sponsors.

 

ELIGIBILITY

To be eligible to Submit Your Photo:

(a) be a legal resident of Canada;

(b) be of the age of majority or older in your province or territory of residence at the time of submission;

(c) be an amateur photographer. For the purposes of these Rules, an “amateur photographer” is a person who has never earned more than $1,000 in a given year for photography; and

(d) be the sole owner of all right, title and interest (including copyright) in and to the Photo (as defined below), or have the required consents from the owner of the Photo, submitted in connection with the “Submit Your Photo”.

The Sponsors shall have the right at any time to require proof of identity and/or eligibility to participate. Failure to provide such proof may result in disqualification. All personal and other information requested by and supplied to the Sponsors for the purpose of the program must be truthful, complete, accurate and in no way misleading. The Sponsors reserve the right, in their sole discretion, to disqualify any entrant should such an entrant at any stage supply untruthful, incomplete, inaccurate or misleading personal details and/or information.

HOW TO SUBMIT

Photos can be submitted starting on March 1, 2017. To submit a photo, you must duly complete and submit a photo submission form located on https://www.caasco.com/CAA-Magazine/Photo-Submissions.aspx, and submit your Photo taken while travelling. Photos must be in digital format. Only online submissions will be eligible. Photos must be high enough resolution to be reproduced in CAA Magazine. Photos must be at least 5 megapixels or 2560 x 1950 pixels. Low resolution Photos that do not meet the requirements of these Rules will be automatically disqualified.

Submissions will be declared invalid if: (i) they are late, illegible, incomplete, damaged, irregular, mutilated, forged, garbled; (ii) mechanically or electronically reproduced; or (iii) include images which are incomprehensible, incomplete, inaccurate, misleading, or detrimental to Sponsors’ reputation, all as determined in the Sponsors’ sole discretion.

Photos must not, in the sole and unfettered discretion of the Sponsors, contain illegal, obscene, provocative, defamatory, sexually explicit, or otherwise objectionable or inappropriate content. Sponsors have the right to remove or replace any files that compromise the security of the server, or are otherwise malignant or deemed inappropriate by Sponsors, in their sole discretion.

There is no limit on the number of submissions per person. All submissions and Photos become the property of the Sponsors and will not be returned for any reason. Submissions not complying with these Rules will be disqualified.

PRIZES

The contest prize is a Canon EOS Rebel T6 DSLR Camera with EF-S 18-55mm f/3.5-5.6 DC III Lens Kit valued at $549.99.

The prize (or portions thereof) is non-exchangeable, non-transferable, non-refundable, have no cash surrender value and must be accepted as awarded with no substitutions. Should a winner be unable to claim the prize (or a portion thereof) as awarded, such winner’s right to the prize (or portion thereof) will be forfeited and another winner will be selected.

PHOTO SELECTION

The winning Photos may be selected periodically from all eligible submissions by a CAA Magazine judging panel. The selection of the winning Photos will be based on the submitted Photos’ overall visual appeal and creativity. All judging criteria will be weighed equally. In the event of a tie, the Photo with the highest score in creativity will be selected. Odds of having your Photo selected are dependent upon the number and quality of eligible submissions received. The author of the winning Photo will be required to comply with all these Rules.

The author of the winning Photo will be contacted by telephone and/or e-mail, and the selected Photo will be posted in a future issue of CAA Magazine.

In the event the author of the winning Photo cannot be contacted within three (3) days of the selection date, he/she will be disqualified and another entrant will be selected in accordance with these Rulesa. The Sponsors are not responsible for the failure by the selected entrant to be successfully contacted as described above.

In consideration of having been selected by the CAA Magazine judging panel, the author of the winning Photo grants the Sponsors the right in perpetuity to publish and use winner’s Photo, as is or as may be edited in Sponsors’ sole discretion, accompanied by author’s full name and city of residence in any advertising and promotion by Sponsors including, without limitation, in CAA Magazine and/or on Sponsors’ websites, without further notice or consideration. The author of the winning Photo agrees to perpetually and irrevocably assign all intellectual property rights including copyright, and waive all moral rights in and to the winning Photo in favor of the Sponsors.

PROPERTY OF SUBMITTED PHOTOS

By participating each entrant represents and warrants that: (i) each submitted Photo is an original work created by the entrant; (ii) the submitted Photo has not been published, publicly exhibited or won an award or selected as a winner in any contest, and all rights, title, and interest (including copyright) therein and thereto is owned and/or controlled by the entrant to the full extent necessary to enable the Sponsors to use the Photo as contemplated by these Rules; (iii) all authorizations or exemptions regarding the constituents and subjects of each submitted Photo have been obtained; (iv) each submitted Photo does not infringe on the copyrights, trademarks, moral rights, rights of privacy/publicity or intellectual property rights of any person or entity or other statutory or common law rights of any third party; (v) each submitted Photo does not contain any unlawful material, or any material that is libelous, defamatory, profane or obscene, or promotes hatred or discrimination; and (vi) without limiting the generality of the foregoing, each submitted Photo does not disparage the Sponsors or any person or entity involved in the production, implementation, administration or fulfillment of this program.

If a Photo contains any material or elements that are not owned by the entrant and/or which are subject to the rights of third parties, and/or if any persons appear in a submitted Photo, the entrant is responsible for obtaining, prior to submission of such Photo, any and all releases and consents necessary to permit the exhibition and use of the Photo in the manner set forth in these Rules without additional consideration. If any person appearing in a Photo is under the age of majority in his/her province or territory of residence the signature of a parent or legal guardian is required on each such release.

Each entrant will indemnify and hold harmless the Sponsors and their respective parent companies, subsidiaries, affiliates, employees, directors, officers, suppliers and agents from any and all liability for any loss, harm, damages, cost or expense arising out of: (i) any violation of the foregoing representations, warranties and obligations; (ii) any violation of these Rules; (iii) any violation or infringement of third party rights including, without limitation, third party intellectual property, privacy and publicity rights; or (iv) any damage related to or in connection with the submitted Photo or the use thereof.

Each entrant agrees to assign to the Sponsors and their respective affiliates, on an exclusive, perpetual, irrevocable, entire and free basis, all intellectual property rights and rights to use the submitted Photos and related concepts. Each entrant hereby waives and relinquishes such rights in the Photos, including all moral rights.

Each entrant agrees that Sponsors may, without any compensation to the entrant from any party, publish, copy, distribute, broadcast or otherwise use the Photos, for the purposes, in the way and at the frequency determined by the Sponsors in their sole discretion (including without limitation for advertising or commercial purposes), on any medium or support, worldwide and in perpetuity. The Sponsors shall have the right to use the Photos at their discretion, including the right to alter, modify or rearrange such Photos.

GENERAL CONDITIONS

By submitting a Photo entrants agree to be bound by these Rules. Entrants further agree to be bound by the decisions of the judges, which shall be final and binding in all respects, without right of appeal.

The author of the winning Photo will be required to execute and deliver the Sponsors’ form of agreement and release: (i) confirming compliance with the Rules and confirming that the winning Photo is the entrant’s own original work or has the required consents from the owner of the winning Photo; (ii) releasing the Sponsors and their respective parent companies, subsidiaries, affiliates, employees, directors, officers, suppliers and agents from any and all liability for any loss, harm, damages, cost or expense arising out of the entrant’s submission, including without limitation costs injuries, losses and damages related to personal injuries, death, damage to, loss or destruction of property, rights of publicity or privacy, defamation, or portrayal in a false light, or from any and all claims of third parties arising therefrom; and (iii) granting the Sponsors the unrestricted right, in their sole discretion, to publish, without any further compensation, the name, picture, portrait, likeness, voice and ideas of the selected entrant for advertising and promotional purposes. If required by the Sponsors, the entrant shall also deliver a model release executed by all individuals depicted in the selected Photo. The agreement and release, and model release if applicable, must be returned within seven (7) days of the notification date indicated on the notification or the selected entrant will be disqualified.

Any submission and any attempt at entering using electronic, computer or other means which are contrary to the spirit of these Rules (e.g., computer pirating, mass e-mailing, etc.) will be automatically rejected and may be referred to the appropriate judicial authorities. Any automated submissions will be noticed and rejected.

In consideration of having been selected by the CAA Magazine judging panel, the author of the winning Photo authorizes the Sponsors, if required, to use his/her name, photograph, place of residence, voice, image and/or declaration regarding such selection for advertising purposes without any addition consideration. Moreover, the author of the winning Photo agrees to permit his/her name and town of residence to be broadcasted on the CAA website, posted to CAA’s social media channels and published in CAA Magazine or other platforms operated or owned by CAA, without any additional consideration.

If an entrant has consented by way of the opt-in on the submission form, the Sponsors may, from time to time, use the personal information provided in connection with “Submit Your Photo” (name, postal code and e-mail address) to: (i) contact the author of the winning Photo in accordance with these Rules; (ii) contact entrants directly regarding products, promotions and services provided by the Sponsors and their affiliates; and (iii) research the effectiveness of their websites and the marketing, advertising and sales efforts of the Sponsors and their affiliates.
