CAA Rescuer™ App Privacy Policy

CAA Club Group (carrying on business as “CAA South Central Ontario” in Ontario and “CAA Manitoba” in Manitoba (“CAA”)) is committed to the protection of your personal information.
This Privacy Policy sets out the privacy practices in connection with use of CAA’s Rescuer Mobile app (“CAA RescuerTM app” or “app”) by you (the “Rescuer”).

1. Definitions
“Affiliate” means an entity that owns or controls, is owned or controlled by, or is or under common control or ownership of a party, where control is defined as the possession, directly or indirectly, of the power to direct or cause the direction of the management and policies of an entity.
“Applicable Law” means all applicable laws, statutes, municipal by-laws, regulations, government codes, and government policies from time to time in force (including all applicable tax, data protection, and privacy laws).
“CAA” means CAA Club Group (operating as CAA South Central Ontario and CAA Manitoba), a corporation incorporated under the laws of Ontario with its head office in Thornhill, Ontario, Canada.
“CAA Data”> means all data, images and photographs related to the access and use of the CAA Rescuer app or obtained in connection with the Terms of Use, including all data related to a Roadside Service Request, to CAA Members, the provision of Rescues and the CAA Rescuer app, feedback or comments provided by Rescuer, and the identification and password key assigned to Rescuer that enables Rescuer to use and access his/her/their Rescuer Account.
“CAA Member” means the person holding a CAA membership card or equivalent or who is otherwise entitled to receive a Rescue by a Rescuer, including Xperigo customers.
“CAA Rescuer™ app” means the software application that is licensed by CAA and that can be used by a Rescuer to receive and respond to Roadside Service Requests.
“Contractor” means CAA’s Appointed Network Contractor for provision of towing related Rescues in accordance with the Roadside Assistance Services Independent Contractor Agreement between CAA and CAA’s Appointed Network Contractor.
“Device” means Rescuer’s personal mobile device used to access the CAA Rescuer app.
“Rescue(s)” mean Roadside Service Requests which a Rescuer accepts via the CAA Rescuer app to handle certain Roadside Service Requests for CAA Members.
“Rescuer” means an individual driver who has been engaged by CAA or a Contractor, as the case may be, to respond to Roadside Service Requests.
“Rescuer Account” means a Rescuer’s account for accessing the CAA Rescuer app.
“Roadside Service Request” means any request to perform roadside services including towing, extraction, battery service and lockout service that a Rescuer receives via the CAA Rescuer app.
“Service Vehicle” means a Rescuer’s means of transportation used to respond to Roadside Service Requests and to provide Rescues.
“Terms of Use” means the binding terms and conditions between CAA and Rescuer that apply in connection with Rescuer’s access to and use of the CAA Rescuer app.

CAA takes responsibility for the management and confidentiality of personal information CAA collects and uses. Personal information is collected, used, shared, and stored in accordance with the Personal Information Protection and Electronic Documents Act, S.C. 2000, c.5 and any applicable provincial privacy laws that may apply to CAA from time to time.

‘Personal information’ is any factual or subjective information, recorded or not, about an identifiable individual.
The following information may be collected by CAA in connection with the CAA Rescuer app.
- Rescuer Profile Information
The initial information provided by you to create a Rescuer account for accessing to use the CAA Rescuer app, including your name, address, e-mail address, Service Vehicle information, Contractor affiliation, and Rescuer Account number. - Automated technologies or interactions
As you interact with the CAA Rescuer app, CAA may automatically collect technical data about your Device. - Location
While the CAA Rescuer app is running, it will track the location of Rescuer’s Device and send it back to CAA for the purposes of dispatching Roadside Service Requests and status updates. Rescuer will install a mapping application, such as Google Maps for navigation and ETA generation purposes. - Camera
This will allow Rescuer to capture images within the CAA Rescuer app to associate with an active Roadside Service Request. - SMS/Text Messaging
This will enable multi-factor authentication and will enable Rescuer to securely login with CAA Dispatch or the Contractor. - Notifications
This will allow Rescuer to receive and view real-time notifications even when the CAA Rescuer app has been minimized or is running in the background. - Device Information
Rescuer’s Device information may be shared with CAA to further optimize CAA’s support and application process.
Personal Information may be collected directly from Rescuer in several ways, including directly from Rescuer or Rescuer’s Device, or indirectly as authorized by law, including through phone calls, electronic messages, as well as any other documents provided to CAA.
Note that there may be instances where the law permits the collection, use or disclosure of Rescuer’s personal information without consent, for example for debt collection, fraud investigations, and where necessary to protect CAA’s legal interests or the safety of others.
Back to top4. Using Rescuer’s Personal Information
CAA uses personal information for the following specific purposes:
- To authenticate and verify that you are a Contractor or Rescuer authorized to use the CAA Rescuer app.
- To confirm Rescuer’s eligibility to provide CAA Emergency Roadside Services.
- To provide Rescuer with CAA Member information including, breakdown location, vehicle type and service requested.
- To communicate with Rescuer and/or the CAA Member in connection with a request for roadside services/Rescues.
- To communicate with Rescuer, including responding to Rescuer’s inquiries and providing technical or User support for the app.
- To confirm the status or completion of roadside services/Rescues assigned to Rescuer.
- To calculate payment due to the Contractor in respect of roadside services provided by Rescuer.
- To respond to requests from law enforcement or complaints from CAA Members or the public.
- To assess and manage risk, including detecting and preventing fraud.
- To meet auditing, legal, and regulatory processes and requirements.
5. Withdrawing your Consent
Subject to legal or contractual restrictions, Rescuer’s consent can be withdrawn at any time by discontinuing the use of the CAA Rescuer app.
Rescuer may also provide CAA with written notice to the contact information found at the end of this policy. Upon receipt of notice to withdraw consent, CAA will inform Rescuer of the consequences of withdrawing consent before CAA processes Rescuer’s request, which may include inability to use the CAA Rescuer app.
Back to top6. Sharing Your Personal Information
CAA takes all reasonable steps to protect the interest of individuals when disclosing personal information to third parties. CAA does not disclose personal information for purposes other than those purposes for which it was collected, unless you have provided consent to do so or CAA is required or permitted by law to disclose the information.
CAA will share your personal information with the Contractor with whom you are employed or engaged. CAA may also share your personal information with CAA Affiliates or third- party technology service providers who may manage or support the app.
CAA takes reasonable steps to ensure that any third parties who CAA entrusts with your personal information are reputable and have safeguards in place to protect this information. In working with business partners, service providers and suppliers, your personal information may be transferred to a foreign jurisdiction to be processed or stored. Such information may be provided to law enforcement or national security authorities of that jurisdiction upon request, in order to comply with foreign laws.

When you use the CAA Rescuer app, CAA automatically receives and records information in CAA’s server logs from your mobile platform, including the date and time of your visit, your IP address, unique Device identifier, browser type and other Device information (such as your operating system version and mobile network provider).
CAA uses “cookies” to identify you as a registered and/or returning visitor. Cookies are files sent from a website to a visitor's computer which may then be stored on your hard drive so CAA can recognize you when you return. CAA uses both session and permanent cookies. This data may be used for statistical purposes and to personalize future visits or communications (via direct mail, email or telecommunications). By setting cookies, CAA is also able to enhance a user’s on-line experience (e.g. once you are logged in to your account, you are able to move between webpages without having to re-enter your credentials). You can disable cookies through your website browser, but this may affect your user experience.
The usage data CAA collects when you use CAA Rescuer app helps CAA analyze and improve the performance of CAA’s digital services. CAA uses Google Analytics for web statistical analysis. CAA makes no effort to personally identify you based on your visit to CAA’s site. If you wish, you may opt out of being tracked by Google Analytics by disabling or refusing third party cookies; by disabling JavaScript within your browser; or by using the Google Analytics, Opt-Out Browser Add-On.
Back to top8. How CAA Stores and Protect Your Information
CAA has implemented critical physical, organizational, and technical measures to guard against unauthorized or unlawful access to the personal information CAA manages and stores. CAA has also taken steps to avoid accidental loss or destruction of, or damage to, your personal information. While no system is completely secure, the measures implemented by CAA significantly reduce the likelihood of a data security breach.
In addition, CAA recommends that you do your part in protecting yourself from unauthorized access to your personal information. For example, ensure your CAA Rescuer app login credentials are not shared with anyone. CAA is not liable for any unauthorized access to your personal information that is beyond our reasonable control.
CAA makes every effort to ensure that the personal information CAA holds is accurate, complete, and up to date for the purposes for which CAA collects it. Let us know right away if your contact information changes or you find any errors. If you have reason to believe that the security of your account has been compromised, you must immediately notify CAA of the problem in order for us to resolve the issue in a timely manner.
CAA retains personal information for as long as necessary to fulfill legal or business purposes and in accordance with our retention schedules. Once your information is no longer required by CAA to meet business, legal or regulatory requirements, it is securely destroyed, erased or made anonymous. Keep in mind however that information may be retained for a lengthier period of time due to an on-going investigation or legal proceeding, and that residual information may remain in back-ups for a period of time after its destruction date.

The CAA Rescuer app is not intended for persons under the age of 18 and CAA does not collect personal information for persons under the age of 18. The CAA Rescuer app is intended only for authorized Rescuers. If you believe CAA might have any information about a child under 18, please contact CAA at privacy@caasco.ca.
